1. Acceptance of Terms
By accessing bostongreens.net (the "Site"), creating an account, placing an order, subscribing to a delivery plan, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site or our services.
Boston Greens Corporation is the legal entity operating under the customer-facing name "Boston Greens."
2. Eligibility & Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate, current, and complete information when creating an account or placing an order, including a valid delivery address and payment method.
3. Products & Orders
Boston Greens sells fresh, precision-grown greens and related products through: online one-time orders with local delivery, recurring subscription boxes, in-person pickup, and wholesale accounts for retailers, restaurants, and food service partners.
All orders are subject to product availability. Because our products are grown to order in small, controlled batches, availability can change quickly, and we reserve the right to limit quantities, substitute a comparable product, or cancel an order if an item becomes unavailable after purchase. If we cancel any part of your order, you will not be charged for the cancelled items, and any amount already charged will be refunded.
Product photos are for illustration; actual appearance, size, and yield of fresh greens may vary naturally by season and harvest.
4. Pricing & Payment
Prices are listed in U.S. dollars and are subject to change without notice, though changes will not affect orders already placed and confirmed. Applicable sales tax, delivery fees, and any wholesale-account terms will be shown at checkout or in your account agreement.
Payment is due at the time of order unless you have an approved wholesale credit account. We accept the payment methods displayed at checkout. You authorize us to charge your selected payment method for the order total, including recurring charges for active subscriptions.
5. Shipping & Delivery
5.1 Local Delivery Area
Boston Greens currently offers local delivery within the Greater Boston area and surrounding communities designated as serviceable at checkout. Enter your address at checkout to confirm delivery availability. We do not currently ship nationally; our model prioritizes short "farm-to-door" times to preserve freshness.
5.2 Delivery Windows
Delivery days and time windows will be provided at checkout or in your order confirmation. We will make reasonable efforts to deliver within the selected window but are not liable for delays caused by weather, traffic, or other events outside our reasonable control.
5.3 Perishable Handling
Our products are fresh, perishable produce. Please arrange to receive deliveries promptly, or ensure a safe location (e.g., an insulated receptacle or shaded porch) is available. Boston Greens is not responsible for spoilage that occurs after a delivery is confirmed successfully delivered to the address on file.
5.4 Missed or Failed Deliveries
If a delivery cannot be completed because no one is available and no safe drop location is provided, or the address is incorrect, we will attempt to contact you. Redelivery may incur an additional fee, and perishable items that cannot be redelivered same-day may not be eligible for replacement.
6. Local Pickup
Customers may choose in-person pickup at designated Boston Greens locations shown at checkout. Orders must be picked up within the timeframe specified in your pickup confirmation. Perishable orders not collected within that window may be donated or discarded and are not eligible for refund.
7. Subscriptions
Subscription boxes renew automatically on the cadence you select (e.g., weekly or biweekly) until cancelled. By subscribing, you authorize recurring charges to your payment method on each billing cycle.
- Skip or pause: You may skip an upcoming delivery or pause your subscription through your account dashboard before the applicable order cutoff time shown at checkout.
- Cancellation: You may cancel your subscription at any time through your account or by contacting us. Cancellation takes effect for the next billing cycle; it does not refund charges already processed for an order in progress.
- Price changes: We will provide advance notice of any subscription price changes before they take effect on your next renewal.
8. Wholesale & Retail Accounts
Wholesale customers (grocery stores, restaurants, and other food service partners) operate under a separate wholesale agreement covering pricing, order minimums, delivery schedules, and payment terms, which supplements these Terms. Where a signed wholesale agreement conflicts with these Terms, the wholesale agreement controls for that account.
Wholesale accounts are subject to credit approval, and Boston Greens reserves the right to require prepayment or adjust credit terms at its discretion.
9. Refunds, Returns & Cancellations
Because our products are fresh, perishable produce, we generally cannot accept physical returns. Our refund policy instead focuses on making things right when something goes wrong with your order.
9.1 Freshness & Satisfaction Guarantee
If your delivered items arrive damaged, spoiled, incorrect, or otherwise do not meet our freshness standards, contact us within 48 hours of delivery with your order number and, where possible, a photo of the issue. We will offer, at our discretion, a replacement on your next delivery, store credit, or a full or partial refund to your original payment method.
9.2 Order Cancellations
One-time orders may be cancelled for a full refund up until the order cutoff/harvest-lock time shown at checkout. Once an order enters harvest or fulfillment, it can no longer be cancelled, since product has already been picked for you.
9.3 Subscription Refunds
Cancelling a subscription stops future charges but does not refund a delivery that has already been harvested, packed, or shipped for the current cycle. Issues with a delivered subscription box are covered by the Freshness & Satisfaction Guarantee above.
9.4 Wholesale Orders
Refunds, credits, and returns for wholesale accounts are governed by the applicable wholesale agreement.
10. Food Safety & Health Disclaimer
Boston Greens grows produce using controlled indoor agriculture practices and follows applicable food safety regulations. However, we are not liable for allergic reactions, sensitivities, or other health effects arising from consumption of our products. Customers with food allergies or medical dietary restrictions should review product information carefully and consult a healthcare provider as needed.
Wash and prepare all produce according to your own food safety practices before consumption.
11. Website Use & Prohibited Conduct
You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to our systems or another user's account; interfere with the Site's operation (including through bots, scraping, or denial-of-service attempts); or submit false, fraudulent, or abusive orders or reviews.
We reserve the right to suspend or terminate accounts that violate these Terms.
12. Intellectual Property
The Boston Greens name, logo, tagline "Traditional Farming Meets AI," and all Site content (text, graphics, photos, and design) are owned by or licensed to Boston Greens Corporation and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
13. Limitation of Liability
To the fullest extent permitted by law, Boston Greens Corporation and its officers, employees, and partners are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
This limitation does not affect any rights you may have that cannot be waived under applicable Massachusetts or federal law.
14. Privacy
Our collection and use of your personal information, including delivery addresses and payment details, is described in our Privacy Policy. By using the Site, you consent to that collection and use.
15. Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, services, or legal requirements. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
